Section 4(2) of the Institute of Chartered Financial Analysts of India University, Sikkim Act 2004 (Act 9 of 2004), which was passed by the Legislative Assembly of Sikkim, authorized the establishment of the ICFAI University, Sikkim. Notification No. 9/LD/2004, dated October 15, 2004, has been sent to the university.
According to Section 22 of the UGC Act of 1956, the University is authorized by the UGC to grant degrees. The university belongs to the Federation of Indian Universities.

ICFAI University PhD Admission Eligibility Criteria
- Master's degree in the subject matter from a foreign educational institution that has been accredited by an Assessment and Accreditation Agency with a minimum of 55% marks or a CGPA of 6.0 on a 10 point scale or its equivalent grade of "B" on the UGC 7-point scale or an equivalent degree.
- Depending on the decision made by the Commission from time to time, candidates from the following groups may be granted an allowance of 5% of their marks—from 55% to 50%—or an equivalent allowance of 5% of their grades—or both.

- Candidates for the M.Phil program & Ph.D candidates must pass the entrance exam.
- The entrance exams will not be taken by candidates who have passed the UGC, CSIR(JRF), NET, SLET, Teacher-Fellowship, MPhil, or any other national level eligibility test.
- To be considered for the personal interview, the candidate must score at least 50% on the entrance exam.
